The Water Policy Interim Committee will be traveling to Hamilton on June 22 to gather public comment on legislative proposals regarding exempt wells.

The exempt well options that will be discussed are:

  • LC 8000 - Define combined appropriation and require CGWA mitigation
  • LC 8001 - Require public water and sewer in certain subdivisions
  • LC 8002 - Reduce exempt well rate and volume
  • LC 8003 - Limit exempt appropriation in confined aquifers
  • LC 8004 - Limit exempt appropriation in subdivisions

WPIC has discussed exempt wells several times during the last few interims. Last session, the Legislature passed HB602 specifically asking WPIC to: “prepare a report to submit to the 63rd legislature that provides clear policy direction and necessary legislation to guide Montana's policy regarding wells that may be exempt from the permitting process.”

In that vein, the WPIC is looking to hear from residents around the state, either at the meetings or in writing. I’m asking for your help in letting people know about the meetings, the proposed bill drafts, and how to comment. Attached is a printable brochure. I’m also including links to the bill drafts. Please forward this note to your membership, email lists or anyone else who may be interested.
