HB 206, Increase justice court filing fees, came out of the House Judiciary Committee amended to phase in the filing fee increase.  It will be going to the floor for second reading on Friday, February 1, so please contact your House Representatives and urge them to support this bill.  The current fees for civil actions do not cover the cost of the proceedings.

HB 220, Revise election laws for county commissioners, will be heard in House State Administration on Wednesday at 8:00.

This bill would require all commissioners be elected only by the voters in their district.  This bill in one form or another has been introduced in nearly every session since I have been at MACo, however it seems to be getting more difficult to kill.  In 2011, it was Senate Bill 302. Senate Bill 302 came out of Senate Local Government committee on a 7-0 vote and died on the Senate floor on a 25-25 vote.  Proponents were Builders, Farm Bureau, Contractors and United Property Owners. This will take a full-court press to kill.

The Joint Select Committee on Pensions held their first organizational/informational meeting on Tuesday, January 22.  Members of both the House and Senate State Administration Committees joined the meeting.

This bill is a portion of HB 542 in 2011 session vetoed by Governor.  The bill changes the primary review criteria for “impact on agriculture” to “impact of proposed subdivision on surrounding agricultural operations.”

MACo has received a request for information about amounts that counties are budgeting for charity care and public health.  Charity care would be any amount the county budgets, whether expended directly of through another agency or organization for things that may not be covered under regular public assistance.  These would be the short-term costs dealing generally with urgent situations such as a tank of gas, meals, or lodging.

HB 122 – the MPERA IRS Qualification bill is scheduled for hearing on Monday, January 21 at 8:00 a.m. in (H) State Admin.  In Section 2 of this bill, there is a new sub-section (7): The board shall require the actuary to prepare for each employer participating in a retirement system the disclosures or the information required to be included in the disclosures as required by law and by the governmental accounting standards board or its generally recognized successor. Each employer shall pay the employer's share of the actuary's cost for preparing the information or disclosures as determined by the board. The board may adopt rules governing how employer costs must be determined and paid."

This is also a Montana Association of Realtor’s bill and was a portion of HB 542 that passed the 2011 legislature and was vetoed by the Governor.  MACo opposed the bill in 2011.  The bill inserts a new section into the law that states a governing body may not consider the impact of a subdivision under review in conjunction with the impact of a future subdivision(s) for which an applicant has not yet been filed.
