The Law & Justice Interim Committee is considering re-introducing HB 365 (Sponsored by Representative Mike Menahan) from the 2011 Session.  The Committee has asked us (MACo) to gather information from the MACo Members as to their comments and/or positions.

In effect, HB 365 would change the standard for emergency detentions as it would allow emergency detention of persons who may not be an imminent danger to self or others, but who are “substantially unable to provide for the person’s own basic needs” like food and shelter. 

Please review the attached bill and fiscal note (accessible through the links above) and provide Sheryl Wood with your comments/position no later than Wednesday, November 30, 2011.

For informational purposes - MACo did not take a position on HB 365 during the 2011 Session. The County Attorney’s Association supported the bill, because they believed it would save money if intervention came earlier.

NOTE:  Comments received will be presented to the Committee and become a part of the public record, unless advised otherwise.
