"Waters of the U.S." Passes House Committee

The House Transportation and Infrastructure Committee passed H.R. 4965, a bill that would prevent the Obama administration from moving forward with its “waters of the U.S.” guidance. The bill passed by a vote of 33-18 June 7.

Supported by NACo, H.R. 4965 was introduced in May by a group of representatives, including Republican and Democrat leadership of the House Transportation and Agricultural Committees. The bill has 68 co-sponsors.

The bill prohibits the EPA or the Army Corps of Engineers from finalizing the Clean Water Act (CWA) guidance titled “EPA and Army Corps of Engineers Guidance Regarding Identification of Waters Protected by the Clean Water Act (EPA-HQ-OW-2011-0409).” The guidance is under final review at the Office of Management and Budget.
