Realty Transfer Certificates Update

The Department of Revenue has updated the Realty Transfer Certificate (RTC) pursuant to 2011 legislative action.  The 2011 law requires that the sale price be disclosed on foreclosure-related transactions, so we have expanded sections four and five of the form to better track distressed sales.  In addition, the Department of Natural Resources and Conservation (DNRC) has added a filing fee log sheet for water rights disclosure to page six.

An electronic fill-in form has been created for easier completion.  We ask that you begin using this fill-in form immediately to record transfers of real property.  Please access the fill-in form on our website at:

Scroll down to “Property Tax Forms” and click on “488 (RTC)”.  You cannot save the data typed into the form; however, you can print the form after completion. 

Attached are two informational sheets to help you and your staff better understand the new changes to the RTC form and how to fill out the form correctly. Attachment A is a list of the new transfer types in part 4 of the form, definitions of each transfer type and what instrument you will need to record for each transfer type.  Attachment “B” includes definitions regarding the RTC that are in statute and a descriptive list of transfer type documents that identifies which documents require an RTC to be filed.

Upon receipt of the updated form, please dispose of all older versions.

Finally, please provide the following information when filling out the RTC form:

  • The last four digits of the social security and/or FEIN numbers for the seller (grantor) and buyer (grantee).
  • The seller and buyer’s daytime telephone numbers in section 2 of the form; the phone number field is located in the SSN/FEIN box within section 2.
  • The death certificate and a copy of the original deed that created a joint tenancy or life estate is required to be attached to the RTC when the transfer by operation of law terminates the joint tenancy or life estate by death.
