On May 25th, MACo and the Montana League of Cities & Towns (MLCT) provided Montana’s counties and cities with land use training and updates on recent land use changes in Montana Law.
In this training we focus on SB 161 from Montana’s 2021 Legislative Session, which generally revised subdivision laws. The act allows for an expedited review for subdivisions that meet certain requirements; exempts certain subdivisions in cities and towns from certain reviews; allows a county to adopt expedited review provisions; requires the local government to hold a hearing to approve or deny a subdivision application for expedited review; and clarifies the amount of time within which a person may bring action to challenge the approval, imposition of conditions, or denial of a preliminary plat and actions taken on a final plat (76-3-625, MCA).
