Position Description

Summary

Anaconda-Deer Lodge County is seeking to hire a Deputy County Attorney. Under the general guidance of the County Attorney, this position is responsible for a variety of professional duties involved in providing a full range of legal services related to county government operations such as misdemeanor and felony criminal prosecution, child abuse/neglect and delinquent youth cases, mental health commitments, guardianships and various civil proceedings, and legal research relative to County legal issues.

Job Characteristics:

Nature of Work

This is responsible, professional, and technical work providing legal services in specialty areas for the County. An employee in this position provides legal representation for the County on issues that involve a specialized area of civil law problems including preparation of moderately complex legal cases for trial; drafting resolutions and documents and the rendering of legal opinions. Position requires adherence to professional standards, confidentiality, and integrity.

Direct contact with the public, fellow employees and supervisor.

Supervision Received

Daily coordination of activities with County Attorney.

Supervision Exercised

Supervision of office staff.

Essential Functions

This position must be able to: maintain records of domestic violence cases; serve as the County Attorney’s designee on boards, coalitions, committees, and groups as assigned; make hiring recommendations and assists the County Attorney in the selection of new personnel; aide the County Attorney in the long range office planning and in developing goals and objectives for entire department.

Areas of Job Accountability and Performance:

  • Assumes responsibility and duties of County Attorney when needed.
  • Responsible for both misdemeanor and felony criminal prosecution, child abuse/neglect and delinquent youth cases, involuntary commitments, various civil proceedings, and for legal research relative to county legal issues that may arise.
  • Maintain work place confidentiality:
    • The County Attorney’s Office is legal counsel for ADLC. As a result, attorneys and all employees in the County Attorney’s Office are bound by the Montana Rules of Professional Conduct. Employees will routinely handle, view, discuss amongst each other, and assist in confidential legal proceedings and the handling of confidential documents. Confidential information shall not be released without the consent of the County Attorney.

Job Requirements: 

Knowledge:

This position requires a thorough knowledge of: criminal and civil laws and procedures; rules of evidence and rules of civil procedures; techniques of court presentation and of investigations and legal research methods.

Skills:

This position requires skills in: communication and legal research; operation of office equipment, typing, computers and applicable software; proper English, spelling, grammar and good penmanship.

Abilities: 

This position requires a high degree of ability to: investigate and prosecute criminal complaints; be organized; work independently; maintain written instructions; establish effective working relationships with fellow employees, supervisors, and the public.

Education and Experience: 

The above knowledge, skills and abilities are typically acquired through a combination of education and experience equivalent to:

  • Must have J.D. Degree and be licensed to practice law in the State of Montana OR receive a license to practice law in the State of Montana within eight months.
  • Prior experience in criminal law or civil law. Work with County, City or Consolidated Government is desired but not required.
